By downloading, installing, or using The Valence ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the App. These Terms form a legal agreement between you and Furkan Dogan, the operator of The Valence.
You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. You may not:
The Valence offers optional premium subscriptions. Subscriptions provide unlimited access to AI-powered features.
New subscribers may be eligible for a 3-day free trial on Weekly, Monthly, or Yearly plans. Trial eligibility is determined by Apple (App Store) or Google (Play Store) based on your account history. After the trial period, you will be automatically charged the full subscription price unless you cancel before the trial ends. Lifetime is a one-time purchase and does not include a trial.
All subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan. Pricing is displayed at the time of purchase and may vary by region.
You can manage or cancel your subscription at any time through your platform's subscription settings:
Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the period ends.
All payments are processed by Apple or Google. Refund requests are handled by the respective platform according to their refund policies:
We do not process refunds directly. We may, in our discretion, contact the platform on your behalf in exceptional cases.
The Valence uses AI-powered features (AI Mentor, Journal AI Insight, Voice Analysis, Daily Protocol, Command Center) to provide personalized guidance. By using these features, you understand and agree:
The Valence is not a crisis intervention tool and is not designed for emergencies.

The App may detect certain crisis-related keywords and display safety resources, but this is not a substitute for professional emergency services.
You retain full ownership of content you create in the App (journal entries, voice memos, reason wall items, etc.). All content is stored locally on your device and is not uploaded to our servers, except as described in our Privacy Policy for AI processing purposes.
You agree not to use the App to create or share content that is illegal, abusive, threatening, or violates the rights of others.
All content within the App that is not user-generated — including text, design, graphics, logos, software, AI prompt structures, and editorial content — is the property of Furkan Dogan and is protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the App without explicit written permission.
The App does not require account creation. All your data is stored locally on your device. You are responsible for backing up your device. We are not responsible for data loss due to device failure, app uninstallation, or similar events. The "Reset All Data" function in Settings permanently deletes all locally stored information and cannot be undone.
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We may update these Terms periodically. Material changes will be communicated through the App or via this page. Continued use of the App after changes constitutes acceptance of the updated Terms.
You may stop using the App at any time. We may suspend or terminate your access to the App if you violate these Terms. Upon termination, your right to use the App ends immediately. Subscription cancellation must be done through the App Store or Google Play as described in Section 4.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or meet your specific requirements. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, in no event shall Furkan Dogan be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to emotional distress, loss of data, or interruption of service. Total liability for any direct damages shall not exceed the amount you paid to us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify and hold harmless Furkan Dogan from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the App.
The App integrates with third-party services including Apple App Store, Google Play, RevenueCat, Google Gemini API, Cloudflare Workers, and Firebase. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved by the courts of Istanbul, Turkey, except where mandatory consumer protection laws of your country of residence provide otherwise.
If you are a consumer in the European Union, you may also have the right to use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

The Valence uygulamasını ("Uygulama") indirerek, yükleyerek veya kullanarak bu Hizmet Şartları'nı ("Şartlar") kabul etmiş sayılırsınız. Kabul etmiyorsanız Uygulamayı kullanmayın. Bu Şartlar, sizinle The Valence operatörü Furkan Doğan arasında yasal bir sözleşme oluşturur.
Uygulamayı kullanmak için en az 13 yaşında olmanız gerekir. 18 yaşın altındaysanız ebeveyn veya yasal vasinizden izin almanız gerekir. Uygulamayı kullanarak bu koşulları karşıladığınızı beyan edersiniz.
Bu Şartlar'a tabi olarak, Uygulamayı kişisel ve ticari olmayan amaçlarla kullanmanız için size sınırlı, münhasır olmayan, devredilemez, geri alınabilir bir lisans veriyoruz. Aşağıdakileri yapamazsınız:
The Valence isteğe bağlı premium abonelikler sunar. Abonelikler AI destekli özelliklere sınırsız erişim sağlar.
Yeni aboneler Haftalık, Aylık veya Yıllık planlarda 3 günlük ücretsiz denemeden faydalanabilir. Deneme uygunluğu hesap geçmişinize göre Apple (App Store) veya Google (Play Store) tarafından belirlenir. Deneme süresi sonunda, deneme bitmeden iptal etmediğiniz takdirde aboneliğinizin tam ücreti otomatik olarak tahsil edilir. Lifetime tek seferlik bir satın alımdır ve deneme içermez.
Tüm abonelikler, mevcut dönemin sonundan en az 24 saat önce iptal etmediğiniz sürece her fatura döneminin sonunda otomatik olarak yenilenir. Hesabınız, mevcut dönemin sona ermesinden 24 saat öncesine kadar seçilen plan fiyatından yenileme için ücretlendirilecektir. Fiyatlandırma satın alma sırasında gösterilir ve bölgeye göre değişebilir.
Aboneliğinizi platformunuzun abonelik ayarları üzerinden istediğiniz zaman yönetebilir veya iptal edebilirsiniz:
İptal, mevcut fatura döneminin sonunda yürürlüğe girer. Dönem bitene kadar premium özelliklere erişiminiz devam eder.
Tüm ödemeler Apple veya Google tarafından işlenir. İade talepleri ilgili platformun iade politikalarına göre işlenir:
İadeleri doğrudan biz işlemiyoruz. İstisnai durumlarda kendi takdirimize bağlı olarak platform ile iletişime geçebiliriz.

Bir ruh sağlığı krizi yaşıyorsanız, kendinize zarar verme düşünceleriniz varsa veya acil tehlike içindeyseniz lütfen:
Uygulama belirli kriz ile ilgili anahtar kelimeleri tespit edip güvenlik kaynakları gösterebilir, ancak bu profesyonel acil servislerin yerine geçmez.
Uygulamada oluşturduğunuz içeriğin (günlük girdileri, sesli notlar, reason wall öğeleri vb.) tam mülkiyeti size aittir. Tüm içerik cihazınızda yerel olarak saklanır ve Gizlilik Politikamızda AI işleme amaçları için açıklananlar dışında sunucularımıza yüklenmez.
Uygulamayı yasa dışı, taciz edici, tehdit edici veya başkalarının haklarını ihlal eden içerik oluşturmak veya paylaşmak için kullanmamayı kabul edersiniz.
Uygulamadaki kullanıcı tarafından oluşturulmayan tüm içerik — metin, tasarım, grafikler, logolar, yazılım, AI prompt yapıları ve editöryal içerik dahil — Furkan Doğan'a aittir ve fikri mülkiyet yasaları ile korunur. Açık yazılı izin olmaksızın Uygulamanın hiçbir bölümünü kopyalayamaz, çoğaltamaz veya dağıtamazsınız.
Uygulama hesap oluşturma gerektirmez. Tüm verileriniz cihazınızda yerel olarak saklanır. Cihazınızı yedeklemek sizin sorumluluğunuzdadır. Cihaz arızası, uygulama kaldırma veya benzeri olaylar nedeniyle veri kaybından sorumlu değiliz. Ayarlar'daki "Tüm Verileri Sıfırla" işlevi, yerel olarak saklanan tüm bilgileri kalıcı olarak siler ve geri alınamaz.
Uygulamanın herhangi bir bölümünü herhangi bir zamanda, bildirim olsun veya olmasın değiştirme, askıya alma veya durdurma hakkını saklı tutarız. Bu Şartları periyodik olarak güncelleyebiliriz. Önemli değişiklikler Uygulama içinden veya bu sayfa üzerinden iletilecektir. Değişikliklerden sonra Uygulamayı kullanmaya devam etmeniz, güncellenmiş Şartları kabul ettiğiniz anlamına gelir.
Uygulamayı istediğiniz zaman kullanmayı bırakabilirsiniz. Bu Şartları ihlal etmeniz durumunda Uygulamaya erişiminizi askıya alabilir veya sonlandırabiliriz. Fesih halinde, Uygulamayı kullanma hakkınız derhal sona erer. Abonelik iptali, Bölüm 4'te açıklandığı gibi App Store veya Google Play üzerinden yapılmalıdır.
Uygulama, açık veya zımni hiçbir garanti olmaksızın "olduğu gibi" ve "mevcut olduğu şekilde" sağlanır. Uygulamanın kesintisiz, hatasız olacağını veya özel gereksinimlerinizi karşılayacağını garanti etmiyoruz. Yasaların izin verdiği azami ölçüde, ticari elverişlilik, belirli bir amaca uygunluk ve ihlal etmeme garantileri dahil tüm garantileri reddediyoruz.
Yürürlükteki yasaların izin verdiği azami ölçüde, Furkan Doğan, Uygulamayı kullanmanızdan kaynaklanan duygusal sıkıntı, veri kaybı veya hizmet kesintisi dahil ancak bunlarla sınırlı olmamak üzere herhangi bir dolaylı, arızi, özel, sonuçsal veya cezalandırıcı zararlardan hiçbir şekilde sorumlu tutulamaz. Doğrudan zararlar için toplam sorumluluk, talepten önceki 12 ay içinde bize ödediğiniz tutarı aşamaz.
Bazı yargı çevreleri belirli garantilerin hariç tutulmasına veya sorumluluk sınırlamalarına izin vermez, bu nedenle yukarıdaki sınırlamaların bazıları size uygulanmayabilir. Bu tür yargı çevrelerinde sorumluluğumuz yasaların izin verdiği azami ölçüde sınırlıdır.
Bu Şartları ihlal etmenizden veya Uygulamayı kötüye kullanmanızdan doğan herhangi bir talep, zarar veya masraftan Furkan Doğan'ı tazmin etmeyi ve zararsız tutmayı kabul edersiniz.
Uygulama; Apple App Store, Google Play, RevenueCat, Google Gemini API, Cloudflare Workers ve Firebase dahil olmak üzere üçüncü taraf hizmetleri ile entegre olur. Bu hizmetleri kullanımınız, ilgili şartlara ve gizlilik politikalarına tabidir. Üçüncü taraf sağlayıcıların uygulamalarından sorumlu değiliz.
Bu Şartlar, kanunlar ihtilafı ilkeleri dikkate alınmaksızın Türkiye Cumhuriyeti yasalarına tabidir. Bu Şartlardan doğan tüm uyuşmazlıklar, ikamet ettiğiniz ülkenin zorunlu tüketici koruma yasalarının aksini öngördüğü durumlar hariç olmak üzere İstanbul, Türkiye mahkemelerinde çözülecektir.
Avrupa Birliği'nde tüketici iseniz, Avrupa Komisyonu'nun Çevrimiçi Uyuşmazlık Çözümü platformunu da kullanma hakkınız olabilir: ec.europa.eu/consumers/odr.
Bu Şartların herhangi bir hükmünün uygulanamaz olduğu tespit edilirse, kalan hükümler tam olarak yürürlükte kalmaya devam eder.
